HIPAA Notice & Health Information Policy

Pathway ABA ("we," "us," or "our") is committed to protecting the privacy and security of our users' information. This HIPAA Notice explains how health-related information is handled on our platform.

1. Pathway ABA's Role

Pathway ABA operates as an online directory platform that connects families with ABA therapy providers.

  • Pathway ABA is not a healthcare provider
  • Pathway ABA is not a covered entity under the Health Insurance Portability and Accountability Act of 1996 ("HIPAA")
  • Pathway ABA is not a business associate of any listed ABA center or provider

2. No Storage of Medical or Insurance Information

Pathway ABA does not collect, store, view, process, or manage any medical, diagnostic, treatment, or insurance information, including:

  • Diagnoses
  • Treatment plans
  • Medical records
  • Insurance cards or policy details
  • Any Protected Health Information ("PHI") as defined by HIPAA

3. Sharing Information with ABA Centers

If a user chooses to share medical or insurance information with an ABA center:

  • That information is transmitted directly and securely to the selected provider
  • Pathway ABA does not have access to this information at any point
  • Pathway ABA does not store or retain this information on its servers
  • All responsibility for handling PHI lies solely with the ABA center or its designated third-party systems.

4. Provider Responsibility for HIPAA Compliance

Each ABA center listed on Pathway ABA:

  • Is independently responsible for HIPAA compliance
  • Must maintain appropriate safeguards for PHI
  • Must comply with all applicable federal and state privacy laws

Pathway ABA does not monitor, control, or audit provider compliance practices.

5. Data We Do Collect

Pathway ABA may collect limited, non-health information necessary to operate the platform, such as:

  • Name and contact details
  • City, state, or location data
  • General inquiry messages
  • Business listing information provided by centers

This information does not include PHI and is governed by our Privacy Policy.

6. Security Measures

While Pathway ABA does not store PHI, we implement reasonable administrative and technical safeguards to protect the information we do collect, including secure transmission and access controls.
