Welcome to Pathway ABA ("we," "us," or "our"). By accessing or using our website, directory, or related services (the "Platform"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree, please do not use the Platform.

1. Definitions

  • "Pathway ABA" refers to the platform operating this directory service.
  • "User" means any individual accessing or using the Platform, including parents, caregivers, and providers.
  • "Center" or "Provider" means any ABA therapy center, clinic, or related service listed on the Platform.
  • "Subscriber" means a Center that has purchased a paid listing plan.
  • "Services" refers to directory listings, scheduling tools, and related features provided through the Platform.

2. Purpose of the Platform

Pathway ABA operates an online directory designed to help families find and connect with ABA therapy providers.

The Platform may include:

  • Listings of ABA centers and providers
  • Search and filtering tools
  • Tour or consultation request tools (if enabled by the Center)

Pathway ABA does not:

  • Provide medical, therapeutic, or professional advice
  • Guarantee the quality, safety, availability, or outcomes of provider services
  • Act as an agent, partner, or representative of any Center

3. Eligibility

  • Users must be 18 years of age or older to use the Platform or purchase subscription services.
  • Centers must be legally operating entities with all required licenses and certifications in their jurisdiction.

4. Directory Listings & Accuracy

  • All listing content is provided and maintained by the Centers themselves.
  • Pathway ABA does not guarantee the accuracy, completeness, or timeliness of listing information.
  • Centers are solely responsible for keeping their information current and accurate.

5. Scheduling Services

  • Scheduling tools allow Users to request tours or meetings with Centers.
  • Availability and confirmation are determined solely by the Center.
  • Pathway ABA is not responsible for missed appointments, cancellations, rescheduling, or communication issues between Users and Centers.

6. Payments & Subscription Plans

  • Subscription plans may be offered on a Monthly, Quarterly, or Annual basis.
  • Fees are billed at the start of each subscription period.
  • All fees are non-refundable, except where required by law.
  • Failure to pay may result in suspension or removal of listings.
  • Payments are processed securely through third-party payment processors. Pathway ABA does not store full payment details.

7. Privacy, Data Handling & HIPAA Compliance

  • Pathway ABA collects only the information necessary to operate the Platform.
  • We do not collect, store, or process Protected Health Information (PHI) under HIPAA.
  • Any health-related documents or insurance information requested by a Center are transmitted directly to the Center or its designated third-party processor.
  • Pathway ABA is not a covered entity or business associate under HIPAA.
  • HIPAA compliance responsibilities rest solely with the Center and/or its third-party service providers.

8. Prohibited Use

Users agree not to:

  • Use the Platform for unlawful purposes
  • Submit false, misleading, or defamatory content
  • Copy, scrape, or reproduce listings for commercial use without authorization
  • Attempt to disrupt or bypass security measures

9. Intellectual Property

  • All Pathway ABA branding, design elements, and platform code are owned by Pathway ABA.
  • Centers retain ownership of their submitted content but grant Pathway ABA a non-exclusive, royalty-free license to display it on the Platform.

10. Disclaimers & Limitation of Liability

  • The Platform is provided "as is" without warranties of any kind.
  • Pathway ABA does not guarantee uninterrupted or error-free service.
  • We are not liable for any damages arising from:
    • Use of the Platform
    • Interactions between Users and Centers
  • Centers are responsible for compliance with all applicable laws and regulations.

11. Indemnification

You agree to indemnify and hold harmless Pathway ABA and its affiliates from any claims or damages arising from your use of the Platform or violation of these Terms.

12. Termination

Pathway ABA may suspend or terminate access to the Platform at any time for violations of these Terms.

13. Changes to These Terms

We may update these Terms periodically. Continued use of the Platform after updates constitutes acceptance of the revised Terms.

14. Governing Law

These Terms are governed by the laws of the State of Georgia, without regard to conflict of law principles.
